Terms of Use

These terms are the agreement between you and the operator of KaChow ("we", "us") for your use of the KaChow app and the service behind it. By creating an account or using the app, you accept them. If you do not accept them, do not use KaChow.

1. Who can use KaChow

You must be at least 13 years old, and old enough to agree to a contract where you live. You are responsible for everything that happens under your account, so keep your password to yourself and tell us at support@kachow.app if you think someone else has access to it.

2. Your content

The photos, captions, comments and profile details you post stay yours. By posting them you give us a worldwide, non-exclusive, royalty-free licence to host, store, resize and display that content for the purpose of operating and promoting KaChow. This licence ends when you delete the content or your account, except for copies already shared with other users or retained in backups until they expire.

You confirm that, for everything you post:

• you took the photo, or you have the right to publish it;
• publishing it does not break anyone else's rights or any law;
• it does not show a person in a way that would violate their privacy.

3. Community rules

KaChow shows content created by other people, and there is no tolerance for abusive users or objectionable content. You must not post or do any of the following:

• content that is pornographic, violent, or gratuitously shocking;
• harassment, threats, hate speech, or content attacking people over who they are;
• illegal content, or content promoting illegal or dangerous acts;
• photographs of people taken to embarrass, expose or track them, or images showing readable licence plates or home addresses used to identify someone;
• spam, scams, or content posted to advertise something unrelated;
• impersonating another person or account;
• scraping, reverse engineering, or hammering our API, or otherwise trying to break, overload or gain unauthorised access to the service.

4. Moderation and enforcement

Every spot and comment can be reported from inside the app, and you can block any account so its content no longer reaches you. We review reports and act on objectionable content and abusive users within 24 hours — by removing the content, suspending the account, or banning it permanently. We may remove content or terminate an account that breaks these terms, at our discretion and without notice where the breach is serious. Banning an account does not entitle you to a refund of any subscription you have paid for.

5. Your garage

Each car model you spot is parked in your garage. A free account can keep 10 cars there. When the garage is full you can still use every other part of the app — post spots of cars you have already parked, comment, follow, and earn points — but a car that is new to you needs a free slot. You can make room by removing a car from your garage, or lift the limit entirely with KaChow Pro. We may change the size of the free garage; if we reduce it, cars already parked stay where they are.

6. KaChow Pro

KaChow Pro is an optional auto-renewing subscription. It unlocks an unlimited garage and the spot map, and puts a Pro badge next to your name. The features included in Pro may change as the app develops.

• Price and period — the price, the billing period and any free trial are shown on the purchase screen before you confirm, and in the confirmation Apple sends you. Prices may differ by country and may change; a price change never applies to a period you have already paid for, and Apple will ask you to agree before it takes effect.
• Payment — payment is charged to your Apple ID when you confirm the purchase. All purchases are made through Apple; we never handle your payment details.
• Renewal — the subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the current period ends. Apple charges the renewal within the 24 hours before that.
• Cancelling — manage or cancel your subscription in the App Store, under your Apple ID → Subscriptions. Cancelling stops future renewals; Pro stays active until the end of the period you have paid for. Deleting the app or your KaChow account does not cancel the subscription.
• Refunds — App Store purchases are refunded by Apple under Apple's policy, not by us. We cannot issue refunds for them, and we do not refund partial periods.
• Restoring — a subscription belongs to your Apple ID and can be restored on your other devices. It is tied to your KaChow account while you are signed in.

If Pro ends, cars already parked in your garage stay there and remain visible, but you cannot park a new one until you are back under the free limit or subscribe again.

7. Points, achievements, quests and leaderboards

Points, achievements, daily quests and leaderboard positions are features of the app. They have no monetary value, cannot be exchanged for anything, and may be recalculated, corrected or reset — for instance to reverse points gained by cheating. They cannot be bought, and a subscription does not award them.

8. Car identification

KaChow can suggest the make and model of a car in your photo using an automated recognition service. These suggestions are estimates and are often wrong; you can always correct them. Do not rely on them for anything that matters, such as valuing or buying a vehicle.

9. Our content

The app, its name, design, and the car catalogue we maintain belong to us and are protected by intellectual property law. You may use them only through the app as it is provided. Manufacturer names and models are used descriptively to identify vehicles; the trade marks belong to their owners, who do not endorse KaChow.

10. Availability

We may change, suspend or discontinue any part of KaChow at any time. We try to keep it running, but we do not promise it will be uninterrupted or free of errors, and we may need to take it down for maintenance. If we discontinue the service altogether while you hold a paid subscription, we will give you notice in the app.

11. Ending the agreement

You can stop using KaChow at any time and delete your account from Settings, which removes your content — cancel any subscription separately in the App Store. We may suspend or terminate your account if you break these terms, if required by law, or if we stop offering the service. The sections that by their nature should survive termination — content licence for material already shared, disclaimers, and limitation of liability — continue to apply.

12. Disclaimers

KaChow is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We are not responsible for content posted by other users. Nothing here excludes rights you have under mandatory consumer law in your country.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential loss, or for lost data or lost profits, arising from your use of KaChow. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the twelve months before the claim.

14. Your safety

Spotting happens in the real world. Pay attention to traffic, respect private property, and follow local law when photographing vehicles and people. You are responsible for your own safety and conduct while using the app.

15. Apple

This agreement is between you and us, not with Apple, and Apple is not responsible for KaChow or its content. Apple has no obligation to provide support for the app or to handle any claim about it. Your use of the app is also subject to the App Store Terms of Service. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Changes to these terms

We may update these terms. The date at the top of this page shows the current version, and we will notify you in the app before material changes take effect. Continuing to use KaChow after that means you accept the new terms.

17. Governing law

These terms are governed by the law of the country in which the operator of KaChow is established, without regard to its conflict of law rules, and without depriving you of the protection of the mandatory law of your own country of residence.
